Terms of Service & Patient Consent

Tellihealth Remote Patient Monitoring Program
Effective Date: June 2026

1. Program Overview

Tellihealth operates a Remote Patient Monitoring (RPM) program that uses SMS text messaging solely to support enrolled patients in managing their chronic conditions. These Terms of Service govern your participation in our SMS communications program and describe your rights and our obligations with respect to all text messages sent through this program.

By enrolling in the Tellihealth RPM program and providing your mobile phone number, you acknowledge that you have read, understood, and agreed to these Terms of Service.

3. Nature & Purpose of SMS Messages

Tellihealth SMS messages are strictly informational and limited to the following healthcare-related purposes:

3.1 Patient Reading Reminders

  • Reminders to submit your scheduled device readings (e.g., blood pressure, blood glucose, weight, pulse oximetry)
  • Alerts that a reading submission is overdue
  • Confirmations that your reading has been successfully received
  • Notifications that a reading requires follow-up from your care team

3.2 Chronic Condition Education

  • Educational tips and information related to managing your specific chronic condition(s)
  • Links to approved patient education materials relevant to your care plan
  • Reminders about condition-related self-care activities (e.g., medication timing reminders, hydration, symptom tracking)
  • Program check-in prompts to support your engagement in your care plan

IMPORTANT: These messages are for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult your healthcare provider for medical decisions.

3.3 Monthly Patient Phone Call Reminders

  • SMS reminders you to complete a monthly care check-in call from your Tellihealth care team

3.4 Messages This Program Will NEVER Send

Tellihealth will not use this SMS program to send:

  • Marketing, advertising, or promotional content of any kind
  • Billing statements, payment requests, or debt collection notices
  • Solicitations for new products or services
  • Any content unrelated to your enrolled care program

4. Patient Consent

4.1 How Consent Is Obtained

Your consent to receive SMS messages under this program is obtained through one of the following methods:

  • Signing an enrollment agreement at the time of RPM program onboarding
  • Completing a digital consent form through the Tellihealth patient portal
  • Verbally confirming consent with your care coordinator, which is then documented in your patient record

4.2 Consent Is Not a Condition of Care

Your consent to receive SMS messages is entirely voluntary. Declining or revoking SMS consent will not affect the quality of your healthcare services, your enrollment in the RPM program, or your relationship with Tellihealth or your care team.

4.3 Implied Consent via Phone Number Submission

By voluntarily providing your mobile phone number to Tellihealth, you are considered to have provided prior express consent to receive healthcare-related informational text messages at that number, consistent with the FCC’s TCPA healthcare exemption and applicable regulations.

5. Message Frequency

The frequency of messages you receive will vary based on your adherence to the program and is variable. As a general guideline:

  • Reading reminders: Up to 1 reminder per scheduled reading window
  • Educational content: Up to 3 messages per week
  • Total messages: Typically, no more than 1 message per day

Please be advised that message frequency may vary based on your participation level. Message and data rates may apply. You will be notified of any significant changes to your messaging schedule.

6. Your Right to Opt Out

6.1 How to Opt Out

You may opt out of receiving SMS messages from Tellihealth at any time using any of the following methods:

  • Reply STOP to any text message to immediately stop all SMS communications from this program
  • Call Tellihealth Patient Support at [Phone Number] during business hours
  • Email [RPM Support Email] with your name, date of birth, and opt-out request
  • Notify your care coordinator in writing or verbally during a care visit

6.2 Processing Your Opt-Out

All opt-out requests will be honored immediately upon receipt. You will receive one final confirmation message acknowledging your opt-out. After that, no further SMS messages will be sent to your number unless you re-consent.

6.3 Cross-Channel Opt-Out

Consistent with updated FCC TCPA consent revocation rules (effective April 2025), an opt-out submitted via SMS will also apply to all other automated communication channels, including automated voice calls and pre-recorded messages, unless you specify otherwise.

6.4 Re-Enrollment

If you have opted out and wish to resume receiving SMS messages, you may re-enroll by contacting your care coordinator or Tellihealth Patient Support. You will be asked to provide renewed consent before messages resume.

7. Privacy & HIPAA Compliance

7.1 HIPAA-Covered Entity

Tellihealth is a HIPAA-covered entity. All SMS communications are designed and operated in compliance with the HIPAA Privacy Rule and Security Rule.

7.2 Protected Health Information (PHI)

Tellihealth takes measures to limit the inclusion of Protected Health Information (PHI) in SMS messages. Where possible, messages are designed to be general reminders or educational in nature rather than containing clinical details. However, you should be aware that:

  • Standard SMS (text messaging) is not an inherently encrypted communication channel
  • Messages may be visible to others who have access to your device
  • Tellihealth is not responsible for unauthorized access to messages once delivered to your device

If you have concerns about the privacy of health information delivered via SMS, please discuss alternative communication preferences with your care team.

7.3 Data Use

Information related to your SMS interactions (e.g., opt-out status, message delivery) is maintained in your patient record and governed by Tellihealth’s Privacy Notice. Tellihealth does not sell or share your mobile phone number or SMS interaction data with third parties for marketing purposes.

8. Mobile Carrier & Message Costs

  • Message and data rates may apply depending on your mobile carrier plan and rate plan.
  • Carriers are not liable for delayed or undelivered messages
  • Tellihealth does not charge patients separately for SMS messages sent through this program.
  • Tellihealth is not responsible for any charges your mobile carrier applies to incoming or outgoing text messages.
  • For questions about your mobile plan’s messaging rates, contact your wireless carrier directly.
  • The program is compatible with most major U.S. wireless carriers. Delivery may vary by carrier or geographic location.

9. Technical Limitations & Disclaimers

Tellihealth makes reasonable efforts to ensure timely and accurate delivery of SMS messages, but cannot guarantee:

  • Uninterrupted or error-free message delivery due to carrier or network limitations
  • That messages will be received if your device is off, out of service range, or has a full inbox
  • Immediate response to replies sent to program messages — SMS replies are not monitored in real time for clinical emergencies

⚠ EMERGENCY NOTICE: If you are experiencing a medical emergency, call 911 immediately. Do not rely on SMS messaging to communicate urgent health concerns. This program is not a substitute for emergency medical services.

10. Modifications to This Agreement

Tellihealth reserves the right to modify these Terms of Service at any time. When material changes are made:

  • You will be notified via SMS at least 30 days before changes take effect
  • Updated terms will be posted at www.tellihealth.com/sms-terms
  • Continued participation in the SMS program after the effective date constitutes acceptance of the revised terms

If you do not agree to the updated terms, you may opt out at any time using the methods described in Section 6.

11. Regulatory Compliance

This SMS program is operated in compliance with:

  • Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, including the FCC’s healthcare exemption
  • FCC Consent Revocation Rules (effective April 11, 2025)
  • Health Insurance Portability and Accountability Act (HIPAA) Privacy and Security Rules
  • Applicable state laws governing healthcare communications and patient privacy
  • CTIA Messaging Principles and Best Practices
